This AUP defines the acceptable and prohibited activities for all users of PrivateByte.com services. It applies to all customers, visitors, and individuals accessing or using our platform. For details on service performance and uptime guarantees, refer to our Service Level Agreement (SLA).
2. Prohibited Activities
The following activities are strictly prohibited when using PrivateByte services:
2.1 Illegal Activities
- Engaging in illegal activities, including but not limited to hacking, fraud, malware dissemination, or unauthorized access to systems.
2.2 Intellectual Property Infringement
- Violating intellectual property rights such as copyrights, trademarks, patents, or trade secrets.
2.3 Spamming and Unsolicited Communications
- Sending spam, phishing emails, or other forms of unsolicited communications.
2.4 Resource Abuse
- Excessive use of resources (CPU, memory, disk space, or bandwidth) that affects server or network performance beyond reasonable limits.
- Customers must adhere to PrivateByte’s Fair Use Policy as outlined in the Terms of Service. Excessive or abusive use of shared resources, including bandwidth, CPU, or storage, is prohibited.
2.5 Network Abuse
- Actions that compromise network stability, such as denial-of-service (DoS) attacks, port scanning, or traffic flooding.
2.6 Prohibited Content
- Hosting or distributing unlawful, defamatory, harmful, or obscene content, including:
- Illegal adult material
- Hate speech or content promoting violence
- Other offensive or infringing content
2.7 Phishing and Fraud
- Conducting phishing scams, piracy, hacking, spamming, or distributing malware, ransomware, or other harmful software.
- Note: Ports 25 and 587 are blocked to prevent email abuse.
2.8 Account Reinstatement
- Creating new accounts after prior termination without written permission from PrivateByte.
2.9 Software Vulnerabilities
- Actions that render servers vulnerable to attacks or incite retaliation against PrivateByte or its partners.
2.10 Unauthorized Data Handling
- Collecting or using personally identifiable information (PII), financial data, or sensitive health data without authorization or in violation of privacy laws.
2.11 Security Interference
- Circumventing or interfering with security features, including running Torrent clients, Tor exit nodes, or similar applications.
2.12 Malicious Software
- Installing or distributing malicious software such as Remote Access Trojans (RATs), ransomware, viruses, or other harmful programs.
2.13 Bandwidth Usage
- The 1Gbps unmetered port provided by PrivateByte is shared among multiple users and may not always deliver the full 1Gbps speed. Actual speeds may vary depending on network activity, congestion, and usage patterns of other users.
- Using the 1Gbps unmetered port in a manner that causes network congestion or disrupts service for others is strictly prohibited.
3. User Responsibilities
All users of PrivateByte.com services must:
3.1 Adherence to Laws
- Comply with all applicable local, national, and international laws and regulations, as well as third-party agreements.
3.2 Security
- Use strong, unique passwords and regularly update software to maintain account security.
- Safeguard access credentials and promptly report any suspected compromise.
3.3 Reporting Violations
- Report any suspected AUP violations or security concerns, including excessive resource usage or bandwidth abuse, to [email protected].
4. Enforcement and Consequences
PrivateByte reserves the right to enforce this AUP through appropriate actions, including but not limited to:
4.1 Warnings
- Users may receive warnings for minor or unintentional misuse of resources, with an opportunity to address the issue.
4.2 Service Suspension or Termination
- For serious or repeated violations, PrivateByte may suspend or terminate services without prior notice.
4.3 Identity Verification
- PrivateByte may request identity verification to investigate suspected violations and determine if continued use of services is permissible.
4.4 Legal Action
- PrivateByte reserves the right to pursue legal action for serious violations, particularly illegal activities or those causing harm to our network or reputation.
5. Amendments and Notifications
PrivateByte may update this AUP at any time without prior notice. Updates will include a timestamp, and users are encouraged to review the AUP regularly. Continued use of our services constitutes acceptance of any changes to the policy.
